Recording Policy
Lucy Gray trading as Laser Pigeon Productions
1. Purpose
Lucy Gray trading as Laser Pigeon Productions ("Laser Pigeon Productions", "we", "us") provides live sound, audio, and related production services, and may occasionally make audio and/or video recordings of musical performances and related events ("recordings").
We respect the intellectual property rights of performers, composers, producers, and other rights holders, and aim to conduct all recording work in a manner consistent with applicable law in New Zealand and, where relevant, Australia.
This policy sets out the conditions under which audio recordings may be made when we are engaged to provide services.
2. Respect for Intellectual Property
We recognise that performers, composers, and other rights holders may hold copyright or related rights in musical works and performances.
We encourage all clients, performers, and recipients of recordings to:
- comply with applicable copyright and performers’ rights laws, including but not limited to the Copyright Act 1994 (New Zealand) and equivalent legislation in Australia where applicable,
- obtain any licences, permissions, or legal advice required for recording, copying, distribution, streaming, broadcast, or public release,
- ensure that any intended use of recordings is lawful.
Laser Pigeon Productions does not provide legal advice regarding copyright, licensing, or performers’ rights.
3. Consent Requirement for Recording
Audio recordings of musical performances will only be made where:
- the performer, band, ensemble, or their nominated representative has given consent, and
- the client engaging Laser Pigeon Productions has confirmed that such consent has been obtained.
We may rely on the client’s representation that consent has been obtained unless we have reason to believe otherwise.
4. Release of Recordings
Unless otherwise agreed in writing:
- recordings will be supplied only to the performer, or
- to a recipient nominated by the performer, or
- to the client where the client confirms they are authorised by the performer to receive the recording.
We may refuse to release recordings where consent or entitlement is unclear.
5. Incidental or Unintentional Recordings
In the course of providing live sound or recording services, audio may occasionally be captured unintentionally or incidentally, including during sound checks, rehearsals, line testing, or troubleshooting.
Such recordings will:
- not be retained,
- not be copied,
- not be released,
and will be deleted as soon as reasonably practicable unless retention is authorised by the performer or their representative.
6. Composer / Publisher Permissions
Laser Pigeon Productions will not normally make enquiries regarding permission from composers, publishers, collecting societies, or other copyright owners where these differ from the performer.
Responsibility for obtaining any required permissions rests with:
- the client,
- the performer,
- or the recipient of the recording,
as appropriate.
7. Client Responsibilities and Indemnity
The client engaging Laser Pigeon Productions is responsible for ensuring that all necessary permissions and consents have been obtained.
The client agrees to indemnify and hold harmless Lucy Gray trading as Laser Pigeon Productions against any loss, damage, claim, cost, or legal liability arising from:
- incorrect or misleading representations that consent has been obtained,
- unauthorised recording, copying, distribution, or use of recordings,
- breach of copyright, performers’ rights, or other intellectual property rights,
- instructions given by the client that result in a recording being made without proper authority.
This indemnity applies to the fullest extent permitted by law in New Zealand and, where applicable, Australia.
8. Recording Quality and Suitability
Unless recording services have been specifically agreed in advance, any recording made during a live event is provided on a best-effort basis only.
Where recording is requested at short notice or is incidental to live sound duties:
- no guarantee is given as to technical quality, completeness, or suitability,
- recordings may be affected by stage layout, microphone placement, equipment limitations, environmental noise, or other factors outside our control.
Live sound systems are not always configured for optimal recording unless this has been planned in advance.
Recordings intended for release, broadcast, or archival use must be arranged prior to the event.
9. Type of Recording Provided
Unless otherwise agreed in writing, recordings made during live events may consist of:
- a stereo mix,
- a matrix feed,
- a monitor mix,
- a front-of-house mix,
- or another available signal path.
Such recordings are not equivalent to a dedicated multitrack recording.
Multitrack recording, isolated stems, or recordings intended for professional release must be arranged in advance and may require additional equipment, personnel, and fees.
10. Audience and Third-Party Recordings
Laser Pigeon Productions is not responsible for recordings made by audience members, venue staff, promoters, or other third parties.
Where audience recording is prohibited, enforcement is the responsibility of the event organiser, venue, or performer.
We will not supply audio feeds to third parties for recording unless authorised by the client and the performer.
11. Technical and Test Recordings
During setup, soundcheck, or operation, short recordings may be made for technical, diagnostic, or system-testing purposes.
These recordings are not intended for release and will be deleted unless retention is authorised.
12. Storage and Retention of Recordings
Unless otherwise agreed:
- recordings will be retained for a limited period only,
- long-term storage is not guaranteed,
- recordings may be deleted after delivery.
Clients and performers are responsible for making their own backups once recordings have been supplied.
We are not liable for loss of recordings after delivery.
13. Performers’ Rights and Moral Rights
Performers may have moral rights and performers’ rights under applicable law.
Laser Pigeon Productions does not waive, transfer, or licence such rights on behalf of any performer.
The client is responsible for ensuring that any use of recordings respects the rights of performers, including rights relating to attribution and protection against derogatory treatment.
14. Limitation of Liability
To the extent permitted by law, Laser Pigeon Productions shall not be liable for:
- loss of profits,
- loss of opportunity,
- loss of reputation,
- indirect or consequential loss,
arising from any recording made or not made.
Total liability for any claim relating to recording services shall not exceed the fee paid for those services.
15. Right to Refuse Recording
Laser Pigeon Productions reserves the right to refuse to make or supply a recording if we reasonably believe that:
- consent has not been obtained,
- the recording may be unlawful,
- the requested use may infringe intellectual property rights,
- or the recording may expose us to legal risk.
16. Jurisdiction
This policy is governed by the laws of New Zealand.
Where work is carried out in Australia, this policy applies to the extent permitted by Australian law, but additional terms may apply.
